Privacy and Confidentiality

The Client may provide BCAL with information that is confidential, sensitive, or commercially valuable (“Confidential Information”), including but not limited to financial information, business plans, trade secrets, internal communications, or personal information not required to be disclosed by law.

BCAL shall keep all Confidential Information strictly confidential and shall not disclose it to any third party except:

(a) as required by law or under the Building Act 2004, or any other statute.

(b) to BCAL’s directors, agents, employees, or professional advisors who have a need to know for the purposes of providing the Services and who are bound by confidentiality obligations; or

(c) with the prior written consent of the Client.

Information that BCAL is required to disclose under statutory obligations, including information contained in building consents, project information memoranda, compliance schedules, code compliance certificates, or related records, is not considered Confidential Information and may be disclosed to the extent required by law.

BCAL shall take all reasonable steps to safeguard Confidential Information from unauthorized access, use, or disclosure while in its possession.
